Terms of use

1. Publisher

ZenConstat is published by Anthony Arade, as a private individual. Contact: [email protected].

2. The service

ZenConstat helps you fill out the European accident statement from your phone:

• prepare your details in advance (insurance, policyholder, driver, vehicle, trailer);
• fill out the statement step by step, alone, two drivers on one phone, or two drivers on two phones linked by a pairing code;
• draw the accident sketch and attach photos of the damage;
• produce the statement as a PDF, in the language and layout of one of the 10 countries offered.

3. Access and cost

The app is free and requires no account. It is funded by a full-screen ad, shown before the document is handed over and provided by Google AdMob.

A statement for one driver, or two drivers on one phone, works without a connection. The two-phone mode and locating the accident require an internet connection.

The publisher may change, suspend or stop all or part of the service, in particular to maintain or secure it.

4. Your commitments

By using ZenConstat, you agree to:

• enter accurate and truthful information;
• use the app only to report a real accident, never for a false statement or insurance fraud;
• use the other driver's information only to complete the statement;
• share your pairing code only with the other driver involved in the accident.

5. The statement produced

The document follows the official layout of the European accident statement. As on paper, it binds the drivers who sign it: read it again before signing, and do not sign a statement you disagree with.

ZenConstat does not send any statement on your behalf: you choose who to send it to. Accepting and processing the statement is up to your insurer; if you have any doubt about the format, check with them. ZenConstat replaces neither your insurer nor legal advice.

6. Two-phone mode

In this mode, each phone sends its part of the statement to our server, which combines them into a single document. This data is kept for 60 minutes at most, then deleted. The service depends on an internet connection and on the server being available: if there is a problem, you can always fill out the statement as two drivers on one phone, without a connection.

7. Personal data

8. Intellectual property

The app, its code, graphic design, texts and logo belong to the publisher. You have a personal, non-commercial right to use the app. You may not copy, modify, resell or distribute it.

The documents you produce with ZenConstat belong to you.

9. Liability

The app is provided as is. The publisher strives to keep it working properly but cannot guarantee that it is error-free or always available. The publisher cannot be held liable for:

• the information entered by the drivers, or the content of the statement they sign;
• decisions made by insurers based on the statement;
• the loss of the data on your phone: remember to export it before changing phones;
• the unavailability of the server used by the two-phone mode.

Nothing in these terms limits the publisher's liability where the law does not allow it.

10. Changes to these terms

These terms may change, for example when a feature is added. The date of the last update is shown at the top of this page. Continuing to use the app after a change means you accept the new terms.

11. Governing law and disputes

These terms are governed by French law. If a problem arises, first write to [email protected] so we can look for an amicable solution. Failing that, the French courts have jurisdiction, subject to the mandatory rules that protect consumers.
